<br /> <br />CHAPTER 3 <br /> <br /> <br />BUILDING REGULATIONS <br /> <br /> <br />SECTION 1: STANDARD ADMINISTRATIVE CODE <br /> <br /> <br />A. CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS <br /> <br />1. Appointment <br /> <br /> There is hereby established a Board to be called the Construction Board of Adjustments <br />and Appeals, which shall consist of seven members and two alternates. The Board shall <br />be appointed by the governing body of the City. <br /> <br /> <br />2. Membership and Term of Appointment <br /> <br />(a) Membership. The Construction Board of Adjustments and Appeals shall <br />consist of five (5) members appointed by City Council. The Board shall be <br />composed of individuals with knowledge and experience in the Technical Codes, <br />such as design professionals, contractors or building industry representatives. In <br />addition to the regular members, the City Council may appoint up to four (4) <br />alternate members. A Board member shall not act in a case in which he has any <br />conflict of interest. <br /> <br />(b) Terms. Two (2) members of the Board and the Chairman shall initially be <br />appointed to serve a two-year term. The remaining two members of the Board <br />shall initially be appointed to serve a one-year term. Subsequent appointments to <br />the Board shall be for two-year terms, in order to stagger the terms of office of the <br />Board Members so that only a portion of the Board is appointed or replaced in <br />any 12-month period. Alternates shall serve for the same period as regular <br />members. The alternates shall serve in the absence of one or more of the regular <br />members. Vacancies shall be filled for an unexpired term. Continued absence of <br />any member from required meetings of the Board shall, at the discretion of the <br />governing body of the City, render any such member subject to immediate <br />removal from office. <br /> <br />(c) Quorum and Voting. All cases heard by the Board shall be heard by at least four <br />(4) members. The concurring vote of four (4) members of the Board is necessary <br />to take any action. In the event that regular members are unable to attend a <br />meeting, the alternate members shall vote. <br /> <br />(d) Secretary of Board. The Building Official shall appoint a Secretary to record <br />minutes of the meetings of the Board and to make a detailed record of all of its <br />proceedings, which shall set forth the reasons for its decision, the vote of each <br />member, the absence of a member and any failure of a member t <br /> <br />3. Powers <br /> <br />The Construction Board of Adjustments and Appeals shall have the power, as further <br />defined in this chapter, to hear appeals of decisions and interpretations of the Building <br />Official and to consider variances to the terms of the Technical Codes. <br /> <br /> <br /> <br /> <br /> <br />3-1 <br />Rev. 02/07 <br /> <br />
